1. Eligibility: This Search is open to anyone regardless of country of residence. The Talent (“You”) are required to ensure you are eligible to participate in your region. Void where prohibited.

2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by the expressed and implied rules as indicated here and in related media. Douglas Coupland has the sole discretion to alter the rules when deemed necessary.

3. Period: June 20, 2016 to August 20, 2016 (midnight, Pacific Time).

4. How to Enter: Submit an unaltered picture of yourself using the online form provided. Pictures will be accepted or rejected at the sole discretion of Douglas Coupland.

5. Rights Granted by You: You hereby transfer full and complete ownership of the provided images to Douglas Coupland to use at his sole discretion. Any derivative works from the original, including but not limited to 3D scanning and printing, remain the property of Douglas Coupland.

6. Terms & Conditions: Douglas Coupland reserves the right to cancel, terminate, modify or suspend the Search, or change the rules (expressed or implied) when deemed necessary.

7. Limitation of Liability: By entering, you agree to release and hold harmless Douglas Coupland and all related parties from any liability whatsoever that may occur, whether caused by negligence or not.

8. Disputes: This Search is governed by the laws of Canada and the province of British Columbia. You agree that all disputes shall be resolved individually between the parties, without resort to any form of legal or class action.

9. Privacy Policy: You acknowledge that your image and personal information will be used and displayed as part of the Search, but otherwise all attempts will be made to ensure your information remains private. This all sounds way scarier than it really is.

Rules

BY SUBMITTING A PHOTO, THE APPLICANT AGREES THAT THE PHOTO COMPLIES WITH ALL CONDITIONS STATED IN THIS SEARCH. DOUGLAS COUPLAND AND THOSE ASSOCIATED WITH IT WILL BEAR NO LEGAL LIABILITY, EXPRESSED OR IMPLIED, REGARDING THE USE OF THE PHOTO BY DOUGLAS COUPLAND AND DOUGLAS COUPLAND SHALL BE HELD HARMLESS BY AN APPLICANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.

By submitting a photo, each applicant acknowledges that he or she has read and understood and complies with, and understands and agrees that he or she shall be bound by, the terms and conditions of this search.

By submitting a photo in accordance with this search, each applicant warrants and represents that his/her photo:

is original to him/her and that the applicant has all necessary licenses, consents and rights in and to the photo to submit it in response to this search;
does not and will not violate any law, statute, ordinance or regulation;
does not contain any reference to or likeness of any third party(ies);
will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
- Nudity;
- Sexual activity;
- Crude, vulgar or offensive language and/or symbols;
- Derogatory characterizations of any ethnic, racial, sexual or religious groups;
- Content that endorses, condones, depicts or discusses any illegal, inappropriate, unsafe, dangerous or risky activity, behaviour or conduct or displays a disregard for safety;
- Commercial messages, comparisons or solicitations for products or services;
- Any identifiable third party products and/or trade-marks, brands or logos. For example, any clothing worn by persons appearing in a photo must not contain any visible logos, trade-marks or other third party materials;
- URLs or links to any websites; and
- Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by Douglas Coupland in their sole discretion.

Any photo that Douglas Coupland deems, in their sole discretion, to violate the terms and conditions set forth above will not be considered.

License to use submitted photos:

By submitting a photo in accordance with this job posting, each applicant grants to Douglas Coupland, in perpetuity, a non-exclusive license to publish, use, adapt, display, reproduce, modify, edit or otherwise use their submitted photo, in whole or in part, for the purpose of administration and promotion of the search or for any other reason. By participating and submitting a photo, each entrant also agrees to release and hold harmless Douglas Coupland and its agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related cause of action.
